Use this Questionnaire if you are hiring IRA LLC attorney Richard Keyt to form an IRA LLC for you.  Before using this form, however, be sure to read “How to Hire Richard Keyt to Form an IRA LLC.”  This article explains the six simple steps you must take to hire Richard.

When you have completed steps 1 – 3, you are ready to answer the questions asked on this IRA LLC Formation Questionnaire.  Before you start this Questionnaire make sure you have the answers to the following questions about your IRA LLC:

  • Name of the IRA LLC
  • The IRA LLC’s address in Arizona unless you will purchase KEYTLaw LLC’s address service for $100/year.
  •  For each owner (member) of the IRA LLC that is an IRA account:

Name of the custodian

Custodian’s address

Name on the custodian’s account.  For example, Pensco Trust IRA #2010020 fbo Homer Simpson.  Fbo means “for the benefit of.”

Name and contact information for the custodian’s contact person

  • For each owner (member) that is a person, entity or trust (not a custodian):

Name of the member

Address and contact information for the member

If a trust:  exact name of the trust, names of trustee(s) and date of the trust agreement

If a company:  exact legal name, state of formation, type of company, name of person who will sign for the company and his/her/its title.

  • Percentage of the IRA LLC owned by each member.  If all of the money is coming from one IRA account there will only be one member (the custodian of the IRA) and that member will own 100% of the IRA LLC.
  • Name(s) and contact information for all managers.  Normally the IRA owner will be a manager so that the owner has “check book” control.  The IRA LLC may have more than one manager.  The manager of the IRA LLC is the equivalent to the president of a corporation.  The manager(s) runs the show.  Only managers have the legal authority to sign contracts and bind the IRA LLC on legal obligations.
