The 6 Steps to Hire Us to Form Your IRA LLC
In forming 10,000+ Arizona limited liability companies, including 350+ LLCs owned by an IRA or a retirement plan, I have learned how to make the IRA LLC formation process very easy. Here are the six steps the IRA owner must accomplish to hire me to form an IRA LLC for $1,997 and get checkbook control over the IRA's funds.
1Research
Spend some time in our Self Directed IRA LLC Article Library and learn how these companies are formed, operated and taxed. The more you know going in, the better your questions will be.
2Get Answers to Your IRA LLC Questions
Call, text or email me, Richard Keyt (Rick) at 480-664-7478 (rk@keytlaw.com) or my son IRA LLC attorney Richard C. Keyt (Ricky) at 480-664-7472 (rck@keytlaw.com) with any question about forming or operating an IRA LLC. We do not charge to answer questions about IRA LLCs, before or after you hire us.
3Open an Account with a Self-Directed Custodian
If your funds sit at a bank or brokerage that will not make self-directed investments — and most will not — you must open an account with a custodian that allows them. Every custodian my clients have used permits investments through an IRA LLC.
When you open the account, the custodian gives you the account's exact legal name and its account number. I need both to form the LLC, because the member of the LLC is the custodian holding the interest for the benefit of your IRA — not you personally.
4Transfer the Funds to the New Custodian
Arrange a direct custodian-to-custodian transfer of the money you want available for investment. Do not take a distribution and redeposit it. A trustee-to-trustee transfer is not a rollover, is not reportable, and is not subject to the one-rollover-per-year limit.
5Complete Our IRA LLC Formation Questionnaire
Go to our online questionnaire at keytlaw.com/irallcq and give us the information we need to form the company. When you click the submit button, we email you a copy of every question and answer you submitted for your records.
6Have the Custodian Pay Our Fee
Our fee is paid by the IRA, not by you personally. Paying it with personal funds is one of the small mistakes that creates a big problem. Two things make it happen:
- Generate the invoice. Use our online do-it-yourself invoice form, enter your information, and click submit. We email you a KEYTLaw, LLC invoice you can hand to your custodian.
- Submit a disbursement request. Download your custodian's disbursement request form from its website, complete it, and send it to the custodian together with the invoice.
As soon as you have an account with a custodian that allows self-directed investments, you can work on steps 4, 5 and 6 at the same time. Most of the calendar time in this process is the custodian's, not ours.
When will we form your IRA LLC?
We form your IRA LLC the day we receive your completed IRA LLC Formation Questionnaire and our fee.
What You Get for the $1,997 Flat Fee
The fee is flat. There is no hourly billing, no charge for phone calls, and no surprise invoice at the end.
- Unlimited telephone calls with me, Richard Keyt (Rick) at 480-664-7478 (rk@keytlaw.com) or my son IRA LLC attorney Richard C. Keyt (Ricky) at 480-664-7472 (rck@keytlaw.com) — before formation and for as long as you own the company.
- Advice on selecting a name and confirmation that the name is available.
- Preparation and filing of the Articles of Organization with the Arizona Corporation Commission, with expedited approval. Your new IRA LLC will be born not later than one business day after we get your formation questionnaire and payment of the fee.
- The approved Articles of Organization emailed to you as a PDF.
- The federal employer identification number (EIN) obtained from the IRS and emailed to you. To open a bank account for the IRA LLC you must give the bank a copy of the Articles of Organization and the IRA LLC's EIN.
- Our 170+ page Arizona LLC Operations Manual, customized for IRA LLCs, including a checklist of 25+ operational tasks in Chapter 3.
- A custom Operating Agreement drafted for an IRA LLC that the member and manager can sign digitally via DocuSign.
- Statutory agent service for the LLC's first year at no charge. Our annual fee after the first year is $99 for this service. You can change the LLC's statutory agent at any time.
- Organizational resolutions authorizing issuance of the membership interest to the custodian and appointing you as manager.
- A membership certificate evidencing the IRA's ownership of the company.
- Copies of the IRS statutes and regulations that apply to IRA LLCs.
- Our article Self-Directed IRA LLC Prohibited Transactions, which is the single most important document in the package.
- A tabbed three-ring binder containing every document, organized behind labeled tabs.
