If you purchased a Silver or a Gold LLC package from Richard Keyt you hired KEYTLaw to obtain an Employer ID number (EIN) from the IRS.  Before we can apply for the EIN, a “responsible person” must complete an IRS Form SS-4, date and sign the form and send it to us.  We cannot apply for your LLC’s EIN until we have a properly completed IRS Form SS-4 because it authorize our legal assistant to contact the IRS on behalf of the LLC and get the EIN.<\/p>\n

The \u201cresponsible party\u201d is the person who ultimately owns or controls the entity or who exercises
\nultimate effective control over the entity. The person identified as the responsible party should have a level of control over, or entitlement to, the funds or assets in the entity that, as a practical matter,
\nenables the person, directly or indirectly, to control, manage, or direct the entity and the disposition of its funds and assets.  The responsible party must be a person, not an entity.<\/p>\n

A responsible party whose name goes in SS-4 box 7a can be any of the following:<\/p>\n

    \n
  • a member or manager of the LLC<\/li>\n
  • a trustee of a Confidential Trust or a revocable living trust<\/li>\n
  • the owner of an IRA account who is also a manager of the LLC<\/li>\n<\/ul>\n

    Even though we are happy get the LLC’s EIN some people think it is easier to get the EIN online on the IRS’ website using its EIN wizard than it is to complete the SS-4, print it, sign it and send it back to us.<\/p>\n

    Two Options<\/strong><\/p>\n

    1. Easiest<\/strong>:  Get the EIN yourself.  Go to the IRS’ EIN wizard<\/a> and give the IRS the same information you will have to enter on the SS-4.  Click on the Begin Application >><\/strong> button near the bottom of the page.  On the next page select the Limited Liability Company LLC option.  The end result will be the IRS will display the LLC’s EIN.  Be sure to write down the EIN or print the page that has the EIN and keep it in a safe place.<\/p>\n
